Complaints

We wish to provide clients with the highest quality of service at all times. Misunderstandings and mistakes can happen, and most disputes may be capable of amicable resolution.

Complaint Policy

Initially, please discuss the issue with Alison Morgan at the time it arises, or as soon thereafter as possible. 

If this hasn’t satisfactorily addressed the issue, please email details of your complaint to Alison Morgan using the above address. 

We aim to acknowledge receipt within five business days. This will detail by when we propose to respond fully in writing to your complaint, including details of any necessary remedial action. 

Alison Morgan is licensed by the ICAEW and bound by its Code of Ethics. If you are not satisfied that the written response to your complaint has resolved it, or if you aren’t satisfied it has been dealt with appropriately, you may complain to our regulatory body, ICAEW by completing and submitting this form.

If your complaint relates to use of your personal data, and hasn’t been satisfactorily resolved by us, you can complain to the Information Commissioner’s Office (“ICO”) (the UK data protection regulator). Further information on your rights and how to complain to the ICO, can be found here.

Insurance

Our Professional Indemnity Insurance and Public Liability Insurance is with QBE UK Limited, effective from 20 June 2025. The territory is worldwide. The jurisdiction territory is worldwide excluding USA and Canada.

Applicable law

Any contract for services provided is governed by the law in England & Wales. 

Other matters required by the Provision of Services Regulations 2009 are dealt with in the engagement letters agreed between us and our clients.

AMIable (“me”, “we”, “mine” “us” or “our”) is strongly committed to protecting personal data. This privacy notice describes why and how we obtain and use personal data and how it is processed.

Data protection

Processed data is stored in print and electronic format. We endeavour to limit the use of print in accordance with our sustainability policy

We take the security of the data we hold very seriously and take measures to ensure the confidentiality and security of the data we use.

Paper data

Copies of data provided to us by our clients in paper format or printed electronic data will be held in secure files on our premises.

Electronic data

Electronic data is stored in emails, on local computers and mobile devices.

Our email provider and website hosting service (IONOS) provides secure encryption on secure servers. 

Documents are stored on our computers and mobile devices using Microsoft 365. Its robust security features are designed to protect user data. Microsoft has stated it uses end-to-end encryption with Advanced Encryption Standard (AES) 256-bit standard for uploads, downloads and back-ups. 

It also adds another layer of security with two-factor authentication and the Secure Socket Layer and Transport Security Layer (SSL/TLS) encryption standard.

Microsoft hosts its data in various data centres including in the European Union. Cloud storage providers located in Germany and Switzerland are amongst the most secure in the world.

Our local computers and mobile devices are password protected and use finger recognition for additional security.

In operating our website, it may become necessary to transfer data that we collect from you to locations outside of the European Union for processing and storing. By providing your personal data to us, you agree to this transfer, storing and processing. We do our utmost to ensure that all reasonable steps are taken to make sure that your data is stored securely.

Unfortunately, the sending of information via the internet is not totally secure and on occasion such information can be intercepted. We cannot guarantee the security of data that you choose to send us electronically, sending such information is entirely at your own risk.

What information we collect, use, and why

Alison Morgan t/a AMIable will not request data from you that includes any special types of information. 

We collect or use the following information to provide and improve products and services for clients, and / or to comply with legal requirements and / or for dealing with queries, complaints, or claims:

  • Names and contact details;
  • Addresses; 
  • Information relating to compliments or complaints;
  • Identification documents; and
  • Any other personal information required to comply with legal obligations.

Why we need it

We need to know your basic personal data to provide you with services in line with any overall contract (i.e. for contract and legitimate purposes). We also process client data for administration purposes to provide engagement letters and invoices. We will not request any personal data from you that we do not need to provide and oversee this service to you.

We process data and documents from our clients, and potentially their clients, as part of our compliance reviews, technical support and other services as described in our engagement letter to our clients. It may also be necessary to process data to prevent or detect crime, fraud or corruption or to defend or take legal actions related to the provision of our services or products.

We have a legitimate interest in requesting and reviewing client files and data when undertaking work for a client. We need to process the data received from our clients to meet the terms of our engagements with them. 

We also have a legitimate interest in retaining the data for the periods described below, including but not necessarily limited to being able to assist clients if they have reason to ask us about the service provided after completion and to defend or take legal actions should the need arise. 

We also retain data to meet our Regulatory obligations including to provide evidence of compliance with those obligations. This data may be provided during monitoring visits by ICAEW or any other Regulatory body, under their respective authority. We do not share data with third parties unless required by Law or to comply with our Regulatory obligations.

In addition to this we may use the information for one or more of the following purposes:

  • to provide information to you relating to other products that may be of interest to you. Such additional information will only be provided where you have consented to receive such information;
  • to inform you of any changes to our website, services or goods and products; and
  • if you have previously purchased goods or services from us, we may provide to you details of similar goods or services, or other goods and services, in which you may have a legitimate interest.

Lawful bases for the collection and use of your data

Our lawful bases for collecting or using personal information to provide and improve products and services for clients and / or to comply with legal requirements are:

  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.
  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are collecting your personal data will allow us to:
    • comply with our contractual obligations as detailed in any letter of engagement, terms of business or other documentation detailing the scope of our agreed services; and
    • provide documentation to you, including but not limited to letters of engagement, the findings from our work, and invoices.

Our lawful basis for collecting or using personal information for dealing with queries, complaints or claims are:

  • Legal obligation – we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.

Data protection rights

  • Your right of access - In accordance with the data protection legislation, you have the right to ask us for copies of your personal information. You can request other information such as details about where we get personal information from and who we share personal information with. There are some exemptions which means you may not receive all the information you ask for. You can read more about this right here.

In most circumstances, we will not charge a fee to deal with a request. However, we reserve the right to charge for the administrative costs of complying with a request if it is manifestly unfounded or excessive, or if an individual requests further copies of their data.

We will respond within one month of receipt of the request.

We may extend this time limit by a further two months, by providing you with written notice of this, if we deem the request to be complex, or if we receive a number of requests from you.

Where an exemption applies, we may refuse to provide all or some of the requested information, depending on the circumstances. We can also refuse to comply with a subject access request, if it is manifestly unfounded or manifestly excessive. 

If we refuse to comply with a request, we will inform you of the reasons why. You will have a right to make a complaint to the ICO or our RPB (ICAEW) pursuant to our Complaint Policy above. You can also seek to enforce this right through the courts.

From where we get personal information

This data is usually obtained directly from you to meet the terms of our engagement. This may include, but is not exclusive to, names, addresses and other contact information of clients and related third parties, books and records and financial information. This data may be in print or electronic format.

We may use publicly available resources such as the R3 annual directories, information from the Registrar of Companies and other similar public-access data providers.

In running and maintaining our website we may collect and process information:

  • about your use of our site including details of your visits such as pages viewed and the resources that you access. Such information includes traffic data, location data and other communication data;
  • provided voluntarily by you. For example, when you register for information or make a purchase; and
  • that you provide when you communicate with us by any means.

How long we keep information

We keep data for periods dictated under various legislative and licensing requirements.

For example, invoices and other accounting records are held in accordance with tax requirements for a minimum period of six years.

Copies of data provided to us by our clients in paper format or printed electronic data will be destroyed using a shredder once the service period to the client (as declared in the relevant engagement letter) has been concluded. Original documents will be returned to the client. 

Apart from documents which may legally belong to the client, we intend to destroy correspondence and other papers (in print and electronic format) that we store after no more than seven years, other than documents for which we have an ongoing legitimate interest in its retention. It is a client’s responsibility to inform us if retention of a particular document is required, for which there may be a charge.

We will not retain copies of Insolvency Compliance Reviews (ICRs) required by the ICAEW, or self-certifications required by the IPA; and any associated documentation, other than as required by our own Regulatory requirements. 

Who we share information with

We will not disclose your personal information to any other party other than in accordance with this Privacy Policy and:

  • to the buyer in the event that we sell any or all of our business;
  • where we are legally or otherwise required including but not necessarily limited to by statute, and by our Recognised Professional Body, to disclose your personal information;
  • to further fraud protection and reduce the risk of fraud;
  • Third Party Links – on occasion we may include links to third parties on this website. Where we provide a link, it does not mean that we endorse or approve that site’s policy towards visitor privacy. You should review their privacy policy before sending them any personal data.
